San Francisco news reports that comedian Tracy Morgan has settled his personal
injury lawsuit against Wal-Mart. The truck accident occurred last year,
killing one man and seriously injuring two others. The settlement amount
The accident occurred when a Wal-Mart truck rear-ended a limo van carrying
the comedian and the other men. Comedian James “Jimmy Mack”
McNair was killed. Morgan suffered a broken leg, broken ribs and head
trauma. The driver of the truck faces criminal charges for allegedly driving
without having had sufficient rest between shifts. Regulations exist concerning
the number of hours truckers can drive. Currently, in the United States,
the Hours of service (HOS) of commercial drivers are regulated by the
Federal Motor Carrier Safety Administration (FMCSA). Commercial motor
vehicle (CMV) drivers are limited to
11cumulative hours driving in a
14-hour period, following a rest period of no less than 10 consecutive hours.
However, despite these laws, truck drivers and trucking companies may try
to skirt these regulations, and place tired and dangerous drivers back
on the road. Accidents related to fatigued truck drivers occur far too
frequently and may cause devastating injuries, such as in this instance.
