Two San Gabriel residents were
killed in an alleged
drunk driving accident this past week, shortly after leaving a bar. The car crash has raised
questions concerning the responsibility of a bar toward patrons. According
to sources, four friends left together from the Villains Tavern in Los
Angeles after enjoying cocktails. Prior to the accident, the group sent
an Instagram photo from the bar with the caption "Drrranks with the
homies." An investigation is ongoing to determine whether the accident
occurred after the group left that bar, or if they went to another location first.
If you have been involved in a serious personal injury accident, consulting
with an experienced
San Francisco personal injury lawyer right away is important to determine your next steps.
California law has limited "dram shop" laws. Dram shop laws impose
liability on bars and restaurants for damages that occur as the result
of serving alcohol to someone who is visibly intoxicated. In California,
a bar that sells alcohol is generally not liable for damages that result
from a person being drunk – even if the seller is aware or should
have been aware of the fact that the person was intoxicated.
However, in many instances it still may be possible to hold a bar or restaurant
responsible for an ensuing drunk driving accident. It is illegal for bartenders
to serve alcohol to an "obviously intoxicated individual," and
each bar is responsible for its actions. As stated by an ABC Officer,
"It's incumbent on every ABC licensee to make sure they follow
all aspects of California law … and that includes not serving alcohol
to minors, to obviously intoxicated persons and they need to be responsible
servers that ensure that their communities are safe."
If you or a loved one has been involved in a drunk driving accident, it
is important to seek the advice of an experienced San Francisco personal
injury attorney to begin an investigation into all possible avenues of
recovery and ensure that those who are responsible compensate you for
the harm caused.
