On the eve of Halloween, a San Francisco toddler was injured while crossing
the street. The pedestrian accident occurred while the girl was in a cross
walk in the city’s Laurel Heights neighborhood. She was taken to
a nearby hospital for treatment for her severe head injuries.
This accident underscores the dangers and need for safety during Halloween
when many kids are out trick-or-treating. Drivers need to be especially
cautious and be on the look out for increased numbers of pedestrians crossing the road.
In fact, statistics show that emergency room visits on Halloween sky-rocket,
as the result of several different types of accidents. In addition to
pedestrian accidents, many drunk driving accidents occur – including
single car crashes and multi vehicle incidents. Further, burn accidents
may occur from jack-o-lanterns and candles. Trick-or-treaters may suffer
injuries as the result of dangerous and/or hazardous property conditions.
Homeowners have a duty to maintain their walkways, steps, porches, etc.
in a reasonably safe condition. If a trick-or-treater is injured, he or
she may be able to file a premises liability claim and recover damages.
Trick or treaters may also be susceptible to dog-bites where homeowners
fail to properly restrain a pet.
