Ship Owners Sue Pharmacists For Negligence In San Francisco Boat Accident

San Francisco news reports that the owners and operators of a ship that crashed into the San Francisco-Oakland Bay Bridge in 2007 have filed a negligence lawsuit against the Petaluma pharmacists that dispensed prescription drugs to the ship's pilot.

The negligence lawsuit provides that the pharmacists "recklessly" provided prescription drugs to John Cota, whose judgment and reflexes became impaired and caused the crash.

Negligence lawsuits are based on the premise that when a person's failure to act with "reasonable care" causes foreseeable harm, he or she may be responsible for the damages and required to pay compensation.

Whenever an accident occurs, many factors may be to blame. It is critical to speak with a knowledgeable San Francisco accident lawyer to evaluate all the factors that caused or contributed to an accident in order to ensure you obtain the compensation you are entitled to.

Here, as a result of the ship accident, more than 50,000 gallons of oil spilled into the bay. The fuel spread to nearby beaches, and has been linked to the death of more than 2400 birds. While the owners and operators of the ship have agreed to pay damages, the lawsuit seeks contribution from the pharmacists for their role in causing the accident. Because California is a comparative law state each party may be held responsible for his or her percentage of fault.

According to reports, he National Transportation Safety Board concluded that Cota's cognitive abilities had been degraded by prescription drug use. The board also faulted Cota, who had been a licensed pilot for 27 years, for choosing to sail in heavy fog, misreading the ship's radar and navigation charts and failing to share his navigation plan's with the captain.
