Oakland Factory Accident Kills Worker

CBS San Francisco News reports that an Oakland man has been killed in a workplace accident. The worker, identified as a 34-year-old fork-lift operator, was using one forklift to lift up another forklift that required servicing. The second forklift came down and crushed his head. The Oakland Fire Department and Paramedics were dispatched after the company called 911. Upon arrival, they pronounced the man dead.

Cal/OSHA will conduct an investigation into the accident to determine whether Super Links Plastics followed adequate safety measures at its Oakland Factory. A routine inspection of the company in 2011 revealed minor seat belt and electrical issues, but violations based on these findings have been challenged.

In the majority of situations, California state and federal worker's compensation laws provide workers and their families rights to recover damages. Workers' compensation was designed to protect individuals and their families from financial losses during times of injury. Although most of the time employees are prevented from suing their employers, in certain situations it may be possible to file a civil lawsuit such as where a third party may be at fault.

Worker's compensation laws are complex. If you or a loved one has been injured at work it's important that you contact an experienced San Francisco workers' compensation attorney at Bostwick & Peterson at once to protect your rights and help you obtain the compensation you deserve.
