San Francisco news reports that Uber has tentatively reached a settlement agreement with the family of a 6-year-old girl who was killed in a car accident. The negligence lawsuit asserts that the girl, her brother, and mother were in a crosswalk crossing the street on New Year’s Eve in 2013 when they were hit by a car. The driver of the car was logged into the Uber app at the time. However, Uber argued that because the driver was not actually transporting any Uber passengers when the accident occurred, it was not at fault.
One of the issues raised this case is whether Uber should be held accountable for the actions of it's drivers, and thus liable and responsible for paying when serious personal injuries occur. Just recently the California labor commission determined that Uber drivers should be considered employees rather than independent contractors. The details of the settlement are confidential.
