Pedestrian Fatalities Reach All-Time High

Bay Area news reports a grim statistic - that San Jose has incurred its 25th pedestrian fatality this year. This figure is a record high for the city. According to reports, the pedestrian was killed while walking along Story Road in East San Jose. He was struck by a vehicle travelling in the road. Drugs and/or alcohol, and speed do not appear to be factors.

This incident remains under investigation. However, questions arise concerning the pedestrian actions, the driver and the roadway. For example, in this case as in other pedestrian accidents its important to look at the roadway in question. Was it safe for pedestrian traffic? Were there clearly marked crosswalks or bike lanes? Was the driver distracted or driving recklessly? Did the pedestrian’s actions increase the likelihood of an incident occurring?
