Jim Bostwick, founder of Bostwick & Associates and a longtime leader in medical malpractice litigation, joined host Kevin Morrison on the Verdict Academy Podcast for its February 26 episode, “The Med-Mal Master’s Playbook.”
In the conversation, Bostwick shares practical insights from decades of trying complex malpractice cases, focusing on disciplined expert selection, rigorous case preparation, and the importance of developing a clear theme that resonates with juries.
“You have to know your case. You have to learn it. You have to understand the medicine, and you have to challenge the experts you’re talking to.”
Bostwick emphasizes that effective malpractice litigation begins long before trial, with a deep understanding of the medicine and a deliberate approach to identifying the right experts.
“I always try to have more than one expert. You hear things differently from different experts, you gain a more nuanced perspective, and you always have a backup.”
He also discusses the strategic role of jury selection, simplifying complex medical issues for jurors, and addressing difficult facts early in order to maintain credibility throughout trial.
