Prenatal Misdiagnosis

San Francisco Prenatal Misdiagnosis Attorney

Failure to Diagnose Birth Defects & Genetic Disorders in California

Only parents of children born with birth defects and genetic disorders can understand the pain and hardship these situations present. Parents hope the world for their children, which is why they are often so devastated when they hear the news that their child has a debilitating birth defect. Most parents want to know about these defects prior to their child's birth, and some want to know so that they can stop the pregnancy.

If your child was born with a birth defect such as spina bifida, cystic fibrosis, or downs syndrome and your doctor failed to make the diagnosis, you may have a prenatal misdiagnosis claim. Contact our award winning attorneys today.

Common Types of Prenatal Misdiagnosis

Many conditions, birth defects, and genetic disorders can have a significant impact on a child's quality of life.

Listed below are some of the most common and commonly tested for:

  • Downs Syndrome - This genetic disorder is caused by an extra chromosome and results in both physical and mental impairments. Doctors can use ultrasounds, blood tests and other prenatal screening tests to identify if a fetus is affected by downs syndrome.
  • Cystic Fibrosis - Like Downs Syndrome, cystic fibrosis is a lifelong disease. Doctors can test for cystic fibrosis even before parents conceive by administering a blood/saliva test to both parents. Because cystic fibrosis is inherited, blood and/or saliva tests should show if either parent carries the cystic fibrosis gene.
  • Spina Bifida - This condition literally means "split spine." There are three major types of spina bifida, some more serious than others. Ultrasounds, AFP tests and amniotic fluid tests should be sufficient in most cases to detect if a fetus is affected by this condition.

Other commonly misdiagnosed genetic disorders are sickle cell disease, fragile X syndrome, and thalassemia.

Do you have a prenatal misdiagnosis lawsuit?

In the obstetrics field of the medical industry, obstetricians are held to a certain standard of care. Part of this standard of care is performing the necessary prenatal screening tests to determine the fetus' health. If your obstetrician/doctor has failed to do this or do this appropriately, you may have a claim.

At Bostwick & Peterson, our California prenatal misdiagnosis lawyers will ask questions like:

  • Did your physician perform all the necessary prenatal tests?
  • Was their interpretation of those tests accurate?
  • Was the misdiagnosis/ failed diagnosis the result of a blatant oversight?
  • Did prenatal testing conform to accepted industry standards?

For more information on prenatal misdiagnosis and to learn if you have a claim, contact Bostwick & Peterson today at (888) 831-8448.
